General Terms of Use and Sale
Last updated: 11 September 2026 · Version française
This is an English translation of the French Conditions générales d’utilisation et de vente, provided for information. In the event of any discrepancy, the French version prevails (Article 16).
Article 1 — Purpose
These general terms and conditions (the “Terms”) set out the conditions of access to and use of the Keeps mobile application (the “App”), as well as the conditions for taking out the paid subscriptions offered within the App.
They form a contract between the publisher of the App and any natural person who downloads, installs, consults or uses the App (the “User”).
They combine the general terms of use (access to the service) and the general terms of sale (paid subscriptions).
Article 2 — Definitions
- App: the Keeps mobile application, distributed on Apple’s App Store and the Google Play Store.
- Account: the personal space created by the User to access the features of the App.
- Memory: content created by a User and associated with a place, including in particular a title, a description, one or more photographs, categories and a visibility status.
- Album: a collection of Memories created by a User.
- Draft: a Memory that has been saved but not published, visible only to the User who created it.
- Premium Subscription: the paid plan giving access to the extended features described in Article 7.
- Store: Apple’s App Store or the Google Play Store, depending on the download platform.

The App was developed on behalf of the publisher by Digital Unicorn, a French simplified joint-stock company (SAS) with share capital of €664,500, 61 rue de Lyon, 75012 Paris, France, RCS Paris 941 024 499, whose involvement entails no editorial responsibility for the content published in the App.
Article 4 — Acceptance and changes to the Terms
Creating an Account requires express and unreserved acceptance of these Terms, given by ticking a box during sign-up. A User who does not accept the Terms must refrain from using the App.
The publisher may amend the Terms at any time, in particular to reflect legal, technical or functional developments. Users are informed of any material change by a message in the App or by email at least thirty (30) days before it takes effect. Continued use of the App after that date constitutes acceptance. If they do not accept, Users may delete their Account under the conditions of Article 15.
Unfavourable changes affecting a Premium Subscription in progress only apply from the following renewal.
Article 5 — Access to the App and Account creation
5.1 Age requirement
The App is reserved for natural persons aged at least fifteen (15). Users residing in a Member State of the European Union that sets a higher age of digital consent must have reached that age. Minor Users declare that they have the permission of their legal representative.
5.2 Account creation
An Account is created by entering an email address and a password, or by signing in with Google or Apple. The User guarantees that the information provided is accurate and undertakes to keep it up to date.
5.3 Security of credentials
Credentials are strictly personal and confidential. The User is responsible for all activity carried out from their Account and shall inform the publisher without delay of any unauthorised use, at the address given in Article 3.
5.4 Equipment and connection
Access to the App requires a compatible device and an Internet connection, the cost and provision of which are the sole responsibility of the User. Some features require location services to be enabled and access to the camera or photo library to be granted.
Article 6 — Description of the Service
The App enables the User to create Memories associated with a place, organise them into Albums, view them on an interactive map and on a timeline, make them public or private, follow other Users and discover public Memories located nearby.
The publisher may change the features of the App, adding or removing features, in order to improve the service or to take account of technical or legal constraints. Where the removal of a feature substantially affects a Premium Subscription in progress, the User may cancel their Subscription under the conditions of Article 7.
Article 7 — Premium Subscriptions
7.1 Free plan and Premium plan
The App is available free of charge in a version in which some features are limited, in particular the number of accounts that can be followed, capped at five (5), and access to advanced search filters.
The Premium Subscription removes the limit on followed accounts and gives access to advanced search features and to the other benefits presented in the App at the time of subscription.
7.2 Plans and prices
| Plan | Duration | Price incl. VAT |
|---|---|---|
| Premium monthly | One (1) month, renewable | €5.99 |
| Premium annual | Twelve (12) months, renewable | €59.99 |
| Premium lifetime | Unlimited duration, one-off payment | €99.99 |
The prices displayed in the App at the time of subscription prevail. They include all taxes and are expressed in the currency of the User’s Store.
7.3 Launch offer
The publisher may run a launch offer granting free lifetime Premium access to the first one hundred (100) registered Users. This offer is limited in time and volume, non-transferable and not exchangeable for its cash value. The exact terms of the offer are displayed in the App when it is activated.
7.4 Subscription and payment
Subscriptions are taken out exclusively through the Store’s in-app purchase mechanism. The contract of sale is concluded with the Store, which collects the payment, issues the proof of purchase and applies its own terms. The publisher has no access to any of the User’s banking data.
7.5 Automatic renewal and cancellation
The monthly and annual plans renew automatically at the end of each period unless the User cancels no later than twenty-four (24) hours before the end of the current period. Cancellation is made from the Store’s subscription settings, the only channel that can stop the renewal; the publisher cannot cancel a subscription on the User’s behalf.
Cancellation takes effect at the end of the period already paid for: the User keeps access to Premium features until that date.
7.6 Right of withdrawal
In accordance with Articles L. 221-18 et seq. of the French Consumer Code, a consumer User has fourteen (14) days to withdraw. By subscribing, the User expressly requests immediate performance of the service and acknowledges losing the right of withdrawal once the service has been fully performed, in accordance with Article L. 221-28, 1° of the same Code.
Refund requests are governed by the policy of the relevant Store and must be addressed directly to it.
7.7 Consequences of the end of the Subscription
When a Premium Subscription expires, the Account returns to the free plan. If the User follows more than five (5) accounts, only the five (5) oldest follows are kept; the others are permanently deleted and are not restored upon a new subscription. The User keeps all of their own Memories, Albums and Drafts.
A User who followed fewer than five accounts keeps all of their follows.
Article 8 — Content published by Users
8.1 User responsibility
The User is solely responsible for the Memories, photographs, texts, categories and other content they publish (the “Content”). They guarantee that they hold all rights necessary for its publication and, where applicable, have obtained the consent of any identifiable persons appearing in the photographs with regard to their image rights.
8.2 Licence granted to the publisher
The User retains ownership of their Content. They grant the publisher a non-exclusive, free-of-charge, worldwide licence to use, reproduce, represent, technically adapt and display their Content, solely for the duration of its publication in the App and solely for the purposes of operating the service: storage, display to authorised Users, resizing, caching and backup.
This licence ends when the Content or the Account is deleted, subject to the technical backup deletion period stated in the privacy policy, and to any copies kept by other Users who saved the Content before its deletion.
Any use of Content for promotional or advertising purposes outside the App is subject to a separate request for authorisation from the User.
8.3 Visibility of Content
The User chooses the visibility of each Memory. A public Memory is accessible to other Users, may appear in the discovery feed, in search results and on the map, and may be saved by other Users. A Draft is not published and is not indexed.
Users are urged to exercise the utmost care before publishing a Memory associated with their home, their workplace or any other place they regularly frequent, and before publishing Memories concerning minors.
Article 9 — Rules of conduct
The User undertakes not to publish or distribute through the App any content that is:
- child sexual abuse material, pornographic or sexually explicit;
- inciting hatred, violence, discrimination, terrorism or suicide;
- defamatory, insulting, harassing or infringing the privacy or image rights of a third party;
- infringing an intellectual property right;
- misleading or fraudulent, or amounting to identity theft;
- unauthorised advertising or promotion, or solicitation.
The User also undertakes not to disrupt the operation of the App, extract its data by automated means, circumvent the limitations of the free plan or access another person’s Account.
Article 10 — Reporting, blocking and moderation
The App provides each User with a content reporting tool and a function for blocking another User, accessible from the relevant screens.
The publisher does not carry out general monitoring of Content. It promptly removes any manifestly unlawful content brought to its attention, in accordance with French Law No. 2004-575 of 21 June 2004 on confidence in the digital economy and Regulation (EU) 2022/2065 on digital services.
Any report may be sent to contact@keepsmap.com. A User whose content is removed or whose Account is suspended is informed and may contest the decision at the same address.
Article 11 — Geolocation
Creating a Memory may rely on the device’s position, obtained with the User’s prior permission. The User may also enter a place manually.
Permission to access location can be withdrawn at any time in the operating system settings. Withdrawal does not affect Memories already saved, whose associated place can be changed or removed by the User.
Map features rely on Google Maps services, the use of which is subject to Google’s terms.
Article 12 — Intellectual property
The App, its structure, interfaces, databases, texts, graphic elements, trademark and logo are protected by intellectual property law and remain the exclusive property of the publisher or its licensors.
The publisher grants the User a personal, non-exclusive and non-transferable right to use the App for the duration of their use of the service. Any reproduction, extraction, adaptation or commercial exploitation, in whole or in part, is prohibited without prior written authorisation.
Article 13 — Availability and liability
The publisher undertakes to use reasonable means to ensure the availability and security of the App, without guaranteeing continuous, error-free operation. Access may be suspended for maintenance operations, announced whenever possible.
The publisher cannot be held liable for damage resulting from the User’s breach of these Terms, non-compliant use of the App, failure of the User’s device or network, or content published by other Users.
Nothing in these Terms limits the publisher’s liability in the event of fraud, gross negligence or personal injury, or where the law prohibits such limitation. The rights that a consumer User holds under the statutory guarantees of conformity and against hidden defects remain unaffected.
Users are advised to keep their own copies of the photographs they publish. The App is not a backup solution.
Article 14 — Personal data
The processing of Users’ personal data is described in the App’s privacy policy, available from the sign-up screen, from the App settings and at keepsmap.com/privacy_policy_en.html. It forms an integral part of these Terms.
Article 15 — Term, suspension and deletion of the Account
These Terms apply for the entire duration of use of the App.
The User may delete their Account at any time, without giving reasons and free of charge, from the App settings. Deletion results in the erasure of the Account and the associated Content under the conditions and within the periods set out in the privacy policy. Deleting the Account does not cancel a Subscription taken out with a Store: cancellation must be carried out separately in the Store settings.
The publisher may suspend or delete an Account in the event of a serious or repeated breach of these Terms, after notification and, where the nature of the breach allows, a formal notice that has remained without effect for fifteen (15) days. In the case of manifestly unlawful content or a risk to Users’ safety, suspension may be immediate.
Article 16 — Miscellaneous
If any provision of these Terms is held to be void or unenforceable, the other provisions remain in full force and effect.
The publisher may assign these Terms as part of a restructuring or transfer of business, without affecting the User’s rights. The User may not assign their Account.
These Terms are drafted in French. In the event of translation, the French version prevails.
Article 17 — Governing law and dispute resolution
These Terms are governed by French law, without prejudice to the more protective mandatory provisions of the consumer User’s country of residence.
In the event of difficulty, the User is invited to contact the publisher at the address given in Article 3 in order to seek an amicable solution.
In accordance with Articles L. 611-1 et seq. of the French Consumer Code, a consumer User may refer the matter, free of charge, to the following consumer mediator: CM2C (Centre de Médiation de la Consommation de Conciliateurs de Justice), 49 rue de Ponthieu, 75008 Paris, France, www.cm2c.net.
